What these terms are
These terms govern your use of liv-instyle.ca. Reading the site, browsing the portfolio, sending the contact form or booking a consultation all count as use, and doing any of them means you accept what is written here. If you do not accept it, the remedy is simple: please stop using the site.
This is a website agreement and nothing more. It is not a construction contract, it does not describe the work we would do in your home, and it does not set a price for anything. Those things live in a separate document, described in clause six.
Who you are dealing with
The site is operated by Liv-Instyle Canada, a design-build cabinetry and renovation business working across Hamilton, Halton, Peel, Waterloo Region and the surrounding counties. Our administrative office is at 717 Mohawk Rd, Ancaster ON L9G 2X1, open by appointment.
We do not run a public showroom, so please do not treat that address as one. Everything on this site is published in English and priced in Canadian dollars.
Using this website
You are welcome to read the site, save pages, print them and share links to them for your own project planning. That is what it is for.
The following are not permitted:
- Copying the photography, drawings, page text or layout for use on another website, in a tender document, or in marketing that is not ours.
- Scraping the site with automated tools, or attempting to interfere with how it runs for anyone else.
- Submitting a booking for an address you have no right to invite a tradesperson to, or giving a name and contact details that are not yours.
- Using the contact or booking forms to send us unsolicited commercial offers, or anything unlawful, misleading or abusive.
We may withdraw access to the site, decline a booking, or delete a submission where any of the above happens. In practice this comes up with bots rather than with people.
Designs, photography and figures on this site are illustrative
Nothing published on this website is an offer capable of acceptance, a quotation, or a price we are bound to honour.
The portfolio shows work we have completed for other clients, in their houses, to their measurements and budgets. It is there to show a standard of finish and a way of working. It is not a catalogue you can order from, and a room that resembles yours is not a promise that yours will cost or look the same.
Where a page gives an indicative investment range, that range describes what similar projects have tended to cost. Any real number depends on the size of the room, the condition of the house behind the cabinetry, the door style, the carcass material, the hardware, the countertop, the appliances you have chosen and what the demolition uncovers. A figure on a web page cannot account for any of that.
Photography is colour-corrected for the web and shown on screens we do not calibrate. Timber, paint and stone all read differently in a photograph than they do in your kitchen, which is precisely why a consultant brings physical samples to your house rather than asking you to choose from images.
Materials, finishes, hardware lines and appliance panel options are subject to availability, supplier changes and discontinuation. We will tell you at design stage if something you have chosen is no longer available.
Booking a consultation creates no obligation
Booking a consultation puts no obligation on you and none on us. Nobody owes anybody anything at the end of it.
The visit is free. The computerized design that follows it is free. The detailed written estimate is free. You are not required to proceed, you are not required to explain why not, and there is no fee, deposit or cancellation charge attached to any of it.
Equally, the consultation does not commit us to taking the project on. We may find that the scope is outside what we do, that the schedule cannot be met, or that the work is better handled by someone else — and if so we will say so early rather than late.
Either side can cancel or reschedule. Please give us as much notice as you reasonably can, since a consultant will otherwise be driving to your door with a case of samples.
Project terms live in the signed agreement
If you decide to go ahead, the work is governed by a written agreement that both parties sign before anything is ordered or demolished. That document, together with the drawings and specification attached to it, is the whole of the deal between us.
It is where you will find:
- The scope of work, the drawings and the specification of materials and hardware.
- The price, the payment schedule and what triggers each stage payment.
- How variations and change orders are priced and approved.
- Lead times, the construction schedule and what happens if either slips.
- The warranty on our cabinetry and installation, and what it excludes.
- Cancellation rights, including any statutory cooling-off period that applies.
Where anything on this website conflicts with your signed agreement, the signed agreement governs. A web page never overrides a contract.
Intellectual property
The photography, drawings, page text, layout, typography and the design system this site is built on belong to Liv-Instyle Canada or to the photographers and suppliers who licensed material to us. Nothing here is public domain and nothing here is free to reuse.
Design drawings and elevations prepared for you remain our intellectual property. Where you proceed with the project, you get the right to use those drawings for your own home, including for permits and for your other trades. Where you do not proceed, the drawings are not licensed for use by another cabinetmaker to build from. Nobody expects a free set of shop drawings, and this clause says so out loud.
We photograph completed work. If you would prefer your project not to appear in the portfolio or on social media, tell us and it will not. That decision is yours and it does not affect anything else.
What you send us
Photographs of your room, measurements, inspiration images, floor plans and notes stay yours. You keep ownership of all of it.
By sending it you give us permission to use it for one purpose: preparing your design, your estimate and your project. We will not publish it, and we will not use it as marketing, without asking you first.
Please only send material you have the right to send. Architectural drawings and photographs are frequently owned by the architect or photographer rather than by the homeowner, and we cannot work from something you are not licensed to give us.
Links and embedded content
The site links out to suppliers, hardware manufacturers, our social accounts and a map provider embedded on the contact page. Those destinations are run by other organizations under their own terms and their own privacy practices.
A link is not an endorsement of everything on the far side of it, and we cannot take responsibility for content, availability or data handling on a site we do not control. When you follow a link away from liv-instyle.ca, these terms stop applying and theirs begin.
Availability of the site
We would like the site to be up all the time and it very nearly is, but no website is guaranteed to be uninterrupted or error-free. Maintenance, hosting incidents and network problems happen.
We may change, move or withdraw any page, service description, image or figure without notice. If a booking cannot be submitted because the site is down, please call (365) 323-9000 — the phone is not affected by a deployment.
Limitation of liability
This clause is about the website only. It has no effect on the liability either side takes on under a signed project agreement, which sets its own terms.
To the fullest extent permitted by Ontario law, Liv-Instyle Canada is not liable for indirect or consequential loss arising from your use of this site, from reliance on an illustrative figure or image published on it, or from the site being unavailable. That includes lost profit, lost opportunity, wasted expenditure and loss of data.
Nothing in these terms limits or excludes liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Anything that cannot lawfully be excluded, including your rights under the Consumer Protection Act, 2002 (Ontario) and the Sale of Goods Act (Ontario).
Consumer protection legislation in Ontario gives you rights that a website cannot sign away, and this clause does not attempt to.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute arising out of them is subject to the exclusive jurisdiction of the courts of Ontario. If a court finds any clause unenforceable, that clause is severed and the rest continues to apply.
How these terms may change
We may revise these terms as the site changes or as the law does. The revised version takes effect when it is posted here, and the date at the top of the page tells you which version you are reading. Continuing to use the site after a change means you accept it.
Changing these terms has no effect on a project agreement already signed. That document can only be varied the way it says it can — in writing, by both parties.
